This presentation discusses the theory and practice of recovery of unlawful and incompatible aid as can be ordered by the European Commission. Attention is paid to the relevant sources of law, main principles in recovery and how it works in practice, with illustrations from the decisional practice of the Commission and CJEU jurisprudence.

Speakers

Jacques Derenne is Partner at Sheppard, Mullin, Richter & Hampton LLP in Brussels and Head of their EU Competition & Regulatory Practice. He has more than 20 years of experience in State aid and has co-directed and co-authored studies for the European Commission on the enforcement of State aid rules at national level. He co-edited a book on the enforcement of EU State aid law at national level (2010). He teaches competition law at the University of Liège and the Brussels School of Competition
