This presentation discusses the judicial review on the merits of Commission decisions in State aid matters. It focuses on the grounds for and scope of review, the issue of manifest error of assessment and the Market Economy Operator Principle (MEOP) test as illustrated by recent case law.

Speakers

Michael Jürgen Werner is Partner in the Antitrust and Competition Practice based in the Brussels office of Norton Rose Fulbright. His practice includes national and EU Competition Law, EU Public Procurement and State Aid Law as well as Regulatory Law and he advises in numerous sectors such as automotive, transport and energy. He is Lecturer on Competition, State Aid and Public Procurement Law and a member to the Advisory Board of the Academy of European Law.

Vincent Verouden is Director at the Brussels office of E.CA Economics. Until recently, he was the Deputy Chief Economist at the Directorate-General for Competition of the European Commission. He is an extramural fellow at TILEC (Tilburg Law and Economics Center), Tilburg University and author of numerous publications on antitrust (vertical restraints, information exchange), merger control and state aid control.
